Please read these Terms & Conditions carefully.
Due to the nature of our medical screening products, it is important that you understand both their benefits and their limitations, as well as the potential risks associated with their use.
These Terms & Conditions apply to all purchases of True Proactive products through our website. By purchasing or using a True Proactive product, you agree to be bound by these Terms & Conditions. IF YOU DO NOT AGREE WITH ANY OF THESE CONDITIONS, DO NOT PURCHASE THE PRODUCTS OR SERVICES.
1. About True Proactive Products
True Proactive supplies point of care and return to lab medical screening tests intended for preliminary health screening only.
True Proactive products are not diagnostic tests and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
The accuracy and reliability of screening tests depend on correct use, including strict adherence to the manufacturer's instructions for sample collection, handling, timing, storage, and result interpretation. As with any medical test, results are not 100% definitive and are intended as a screening guide only, to be considered and managed in consultation with your healthcare provider.
The information provided through the Site, the Services, Test Information, and the Products are for general guidance only and are not a substitute for professional medical advice. Neither the Site nor our Services, Test Information, or Products constitute medical advice and you should always seek the advice of your physician or other registered healthcare professional with any questions you may have regarding any Test Information or status of your health.
Failure to follow instructions exactly may result in inaccurate, invalid, or misleading results.
2. Medical Disclaimer (Important)
By purchasing or using a True Proactive product, you acknowledge and agree that:
- Test results are provided for informational purposes only. They may help guide your understanding of your health but do not constitute a clinical diagnosis.
- While we work exclusively with accredited laboratories and validated point of care technologies or manufacturers, no laboratory test, point of care test, or any medical test is perfect. Test results may occasionally be inaccurate or inconclusive, and you must always bear that in mind in any future decision making.
- Screening tests can produce false negative results, where a condition is present but not detected, as well as false positive results, where a test is abnormal despite no underlying condition being identified on further investigation.
- Screening tests are not 100% accurate. False positive and false negative results can occur. A normal result does not guarantee the absence of disease; an abnormal result does not confirm the presence of disease.
- Results are highly dependent on correct use according to instructions.
You further acknowledge and agree that:
- All results (normal, abnormal, or unclear) should be discussed with a qualified healthcare professional.
- Any abnormal, unexpected, or concerning result must be followed up with a doctor.
- You will not delay, avoid, or change medical care based solely on a screening result.
True Proactive does not provide medical advice, diagnosis, or clinical interpretation. True Proactive acts solely as a retailer and facilitator of screening tests and does not provide personalised medical advice, diagnosis, treatment, or clinical decision-making. You are responsible for arranging follow up with your healthcare provider to discuss results, further investigations, or referrals as appropriate.
True Proactive is not responsible for independent clinical decisions made by you or your healthcare provider based on screening results.
True Proactive products do not replace consultation with a qualified healthcare professional.
By purchasing and using a True Proactive product, you acknowledge and accept the inherent limitations and risks of medical screening, including the risk of false reassurance or unnecessary anxiety.
3. Intended Use Only
True Proactive products must be used exactly as instructed by the manufacturer.
You must not:
- Deviate from the instructions for use
- Use expired products
- Use products that have been stored incorrectly
- Interpret results outside the stated testing window
- Reuse, share, or transfer products intended for single person use
Results obtained from incorrectly used tests may be unreliable and should not be relied upon for any health-related decision.
4. User Responsibility and Acknowledgement
By purchasing or using a True Proactive product, you acknowledge that:
- The accuracy of screening tests depends on correct sample collection and strict adherence to instructions.
- You are responsible for deciding whether to purchase and use a screening test.
- You are responsible for following all instructions provided.
- True Proactive is not responsible for errors arising from incorrect use of a product.
You agree to seek medical advice to discuss your results regardless of outcome. True Proactive does not and is unable to provide medical advice and does not arrange further investigations or referrals; these should be discussed with your healthcare provider as appropriate.
5. Results Handling and Follow Up
True Proactive does not interpret results or provide medical advice.
You are strongly advised to discuss all test results with your general practitioner or healthcare provider, including results that appear normal.
True Proactive does not provide emergency services or any medical management or advice. If you experience severe, worsening, or concerning symptoms, seek urgent medical care regardless of any screening result.
6. Eligibility
By purchasing a True Proactive product, you confirm that you are aged 18 years or over, or that you fall within the recommended age range specified for the individual product purchased (for example, the PSA test is recommended for males aged 50–69).
7. Orders, Pricing, and Payment
All prices are listed in New Zealand dollars (NZD) unless otherwise stated and include GST where applicable.
Payment must be made in full at the time of purchase.
True Proactive reserves the right to refuse or cancel any order at its discretion, including where products are unavailable or where incorrect pricing has occurred.
8. Shipping and Delivery
True Proactive will arrange delivery to the address provided at checkout.
Delivery timeframes are estimates only and may vary due to factors beyond our control.
Risk in the products passes to you upon delivery to the nominated address.
9. Refunds, Returns, and Faulty Products
Due to the nature of medical testing products:
- We do not accept returns or provide refunds for products that have been opened, used, or tampered with, except where required by law.
- We do not provide refunds for change of mind.
If a product is faulty, damaged, or incorrect on delivery, please contact us within a reasonable timeframe so we can assess the issue and provide a remedy in accordance with New Zealand consumer law.
10. Consumer Guarantees (New Zealand)
Nothing in these Terms & Conditions limits or excludes any rights you may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
11. Limitation of Liability
To the maximum extent permitted by law:
- True Proactive's liability is limited to the replacement or refund of the product purchased.
- True Proactive is not liable for any indirect, incidental, or consequential loss arising from the use or misuse of its products.
This clause does not limit any liability that cannot lawfully be excluded.
12. Privacy
Your use of True Proactive products and services is subject to our Privacy Policy, which explains how personal and health information is collected, used, stored, and protected.
13. Changes to These Terms
True Proactive may update these Terms & Conditions from time to time. The version in force at the time of purchase will apply to your order.
14. Governing Law
These Terms & Conditions are governed by the laws of New Zealand, and any disputes are subject to the exclusive jurisdiction of the New Zealand courts.
15. Confidentiality and Information Sharing
True Proactive treats all personal and health information as confidential. By purchasing and using our services, you consent to True Proactive sharing relevant test information with your nominated general practitioner or healthcare provider where appropriate for clinical follow-up, continuity of care, or safety.
